Overview

HEKA is the trade name used by the owner and operator of this store. Throughout these Terms of Service, the terms “HEKA,” “we,” “us,” and “our” refer to the owner and operator of HEKA.

HEKA operates this website and store, including all related information, content, features, products, tools, and services offered through it (collectively, the “Services”). Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.

These Terms of Service, together with our Privacy Policy, Return & Exchange Policy, Shipping Policy, and any other policies referenced on this website, govern your access to and use of the Services.

Please read these Terms carefully. By visiting our website, creating an account, or purchasing from HEKA, you agree to be bound by these Terms. If you do not agree, you should not access or use the Services.

Nothing in these Terms limits any rights that cannot legally be excluded under applicable consumer law.

1. Eligibility and Use of the Services

By using the Services, you confirm that you are at least the age of majority in your state, province, or country of residence, or that you have permission from a parent or legal guardian.

You may use the Services only for lawful, personal, and non-commercial purposes. You may not use our products or Services for any illegal or unauthorized purpose.

  • Refuse orders that appear to be placed for unauthorized resale

Any product offer is void where prohibited by law.

4. Orders

Placing an order constitutes an offer to purchase. An automated order confirmation does not necessarily mean that your order has been accepted.

We reserve the right to accept, reject, limit, or cancel an order for legitimate reasons, including:

Payment information may be processed by Shopify and third-party payment providers. HEKA does not independently control those providers’ processing systems.

6. Promotions and Discount Codes

Promotions and discount codes may be subject to separate conditions, expiration dates, product exclusions, geographic restrictions, and usage limits.

Unless expressly stated otherwise:

  • Promotions cannot be combined

  • Discounts cannot be applied retroactively

  • Discount codes have no cash value

  • Promotions may be modified or ended at any time before an eligible order is placed

If promotional terms conflict with these Terms, the promotional terms will control for that promotion.

7. Shipping and Delivery

Shipping and delivery estimates are provided for convenience and are not guaranteed.

Delivery may be affected by carrier delays, customs processing, weather, incorrect address information, or circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Additional shipping costs caused by an incorrect or incomplete address may be charged to the customer where permitted by law.

Risk of loss passes to you when the order is delivered to you or a person designated by you, except where applicable law provides otherwise.

International customers are responsible for applicable customs duties, import taxes, brokerage charges, and local fees unless expressly stated otherwise at checkout.

8. Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed by our Return & Exchange Policy, available on this website.

Nothing in our Return & Exchange Policy or these Terms limits any mandatory rights relating to faulty, defective, damaged, or incorrectly described products.

9. Gift Cards

Gift cards are non-refundable and cannot be redeemed for cash except where required by law.

You are responsible for protecting your gift-card information. HEKA is not responsible for unauthorized use of a gift card unless caused by our own failure to exercise reasonable care or where applicable law provides otherwise.

10. Intellectual Property

The Services and their contents—including the HEKA name, logos, graphics, photographs, videos, text, product names, product designs, website design, layout, and other materials—are owned by or licensed to HEKA and are protected by applicable intellectual-property laws.

HEKA’s names, logos, designs, and slogans may constitute registered or unregistered trademarks and trade dress.

You may not reproduce, copy, modify, distribute, sell, license, publish, display, create derivative works from, or commercially exploit any portion of the Services without prior written permission.

You may access and use the website for personal shopping and other lawful, non-commercial purposes.

11. Reviews, Feedback, and Submissions

If you submit reviews, photographs, suggestions, comments, ideas, or other content to us, you confirm that you own or have permission to submit that content.

You grant HEKA a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, display, and distribute that content for operating, improving, and promoting HEKA and the Services.

This license does not transfer ownership of your content to HEKA.

13. Shopify

Our store is hosted by Shopify. Purchases made from this store are transactions directly between you and HEKA, not between you and Shopify.

Shopify provides the ecommerce platform and may process information as described in our Privacy Policy and Shopify’s own privacy notices.

Shopify is not responsible for HEKA’s products, product descriptions, order fulfillment, customer service, returns, or other aspects of transactions between you and HEKA.

14. Prohibited Uses

You may not use the Services to:

  • Violate any applicable law or regulation

  • Infringe intellectual-property, privacy, publicity, or other legal rights

  • Submit false, fraudulent, or misleading information

The remaining provisions will continue in full force and effect.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute that may lawfully be required to be brought in California will be subject to the applicable state or federal courts located in Los Angeles County, California.

If you are a consumer residing outside California, this section does not deprive you of mandatory protections or legal remedies available under the laws of your place of residence.

We may update these Terms to reflect changes to the Services, our practices, or applicable law.

The revised version will be posted on this page with an updated revision date. We will provide additional notice where required by law.

Changes will not retroactively reduce rights relating to orders already accepted unless permitted by law.
